Shifting rows in report destroy local member in other report

Hi everybody,

 

we use BPC 10 for MS and I have a sheet with two reports. The first report varies in length between say 4 and 15 rows. The second report has a local member defined like this:

 

=IF(B37="","",IF(AND(C37<>"",D37<>""),"BE",IF(left(C37,5)="FISTL","FISTL",IF(AND(B37<>"",C37="",D37=""),"department",IF(AND(C37="",D37<>""),"divison")))))

 

This local member defines at which level of hierarchy I am so that I can easily use conditional formatting with my data. The problem is, that this only works when the first report has only 4 rows. Whenever I change the context so that the first report has more rows, the second report slides down - that's ok, so that they don't interfere with each other. BUT: the local member formula stays the same: so even if my data starts at B40 after the report sliding down, the local member still looks at B37, completely messing up my logic...

 

Can I either make my local member more dynamic so that it looks at B40 if my report starts at row 40 and not at B37 (better choice) or prevent the second report from sliding down, so that row 37 is always my starting row (I'd prefer the first option, if that's possible...)
